In this privacy statement, ELLE Midwives informs clients about the client's rights regarding his/her personal data. This privacy statement applies to the care services offered by ELLE Midwives within the midwifery practice, via the website and the ELLE Midwives app. The privacy statement describes, among other things, which (categories of) personal data are collected, for what purpose the personal data are used, and to which categories of recipients the personal data are provided.

Processing of Personal Data
ELLE Midwives processes your personal data because you use our services and/or because you provide them to us yourself. Processing data of minors takes place after written consent from parents/guardians.
Clients' personal data are processed by ELLE Midwives for the following objectives:

• execution of the medical treatment agreement; (such as creating your file, logging into your account, creating a link with Zwangerenportaal, maintaining your medical file, scheduling an appointment, keeping track of your stated preferences)
• administrative purposes; (such as sending a newsletter/informational email, carrying out other services requested by you, such as registering for the ELLE Midwives app)
• improving our services (such as sending/processing a complaints or client survey).
  Legal bases for processing are:
• the medical treatment agreement;
• consent;
• legitimate interest of ELLE Midwives;

Which Personal Data are Processed by ELLE Midwives:
Name, first names, initials, title, gender, date of birth, address, postal code, place of residence, telephone number, email address and similar data of the pregnant woman and her partner required for communication. Medical data and other special personal data, including citizen service number, if and insofar as necessary for the execution of the medical treatment agreement and billing costs to the health insurer;
Address details for quality monitoring and follow-up of treatment under the Population Research Act (counseling data and prenatal screening);
Complaints and comments about the treatment of the person involved;
Other data strictly necessary for proper treatment and handling of the treatment.
The above list is not exhaustive and may vary depending on the treatment agreement.

Online Registration of Personal Data
Personal data are registered in the online midwifery registration system Onatal. Onatal is NEN certified and complies with security standards set in the GDPR. This system is only accessible to midwives and assistants registered with the practice. All these healthcare providers have a legal duty of confidentiality (professional secrecy). Registration of address details, date of birth, BSN and health insurance number are processed digitally for customer database, identity verification and submitting claims to the health insurer.

Email Address
Email addresses are processed digitally for exchanging or sending:
newsletters from ELLE Midwives, invitations and registrations for using the ELLE Midwives app, the pregnancy calendar from the ELLE Midwives app, invitations to participate in surveys for evaluating care by ELLE Midwives, contact details to collaboration partners if additional ELLE Midwives services are used. These partners include, e.g., acupuncturist, osteopath, physiotherapist, yoga teacher, pregnancy and/or postpartum coach, doula, gym owner and pregnancy photographer. This is done via unsecured email.
Medical data and exchange with third-party healthcare providers is done via secured email.
Partner email address is not used in principle.

Photo in Medical File
A requested webcam photo is only stored in the medical file for client recognition by midwives and assistants for care provision. The webcam photo file is deleted after linking to the medical file.

Sharing Health Status

1. With other healthcare providers: Processing data on clients' current and past health status, the (future) child's health status, performed examinations and treatments are recorded for care provision. These data are only shared with other healthcare providers if medically necessary and for care purposes. Providers include, e.g., gynecologists, clinical midwives, pediatricians, GPs, child health clinic, maternity care and health insurers for billing.
2. Automated decision-making: ELLE Midwives does not make decisions on matters that may have (significant) consequences for persons based on automated processing. This refers to decisions made by computer programs or systems without human intervention. ELLE Midwives uses the following programs/systems:
   Onatal (online midwifery registration system)
   Zorgdomein and zorgmail (secured communication with other providers)
   Perined Insight (national midwifery database, anonymous data collection)
   Vecozo (system to communicate with health insurers).
   These activities have no privacy impact due to data encryption.
3. Other systems used by ELLE Midwives:
   Zwangerenportaal. Zwangerenportaal provides pregnant women digital access to their medical file. Pregnant women also receive additional relevant information on pregnancy and birth. This occurs in a secure online environment with account verification. Advertisements are shown for commercial benefit based on postcode and IP address, making the person identifiable.    ELLE Midwives App. The app is only available to ELLE Midwives pregnant women via app store. It provides access to medical file via Zwangerenportaal link and extra info on pregnancy, birth and postpartum. It has a chat function for communication with other ELLE Midwives pregnant women with explicit consent. Check the ELLE Midwives app privacy statement.

Registering with the Practice
If you register via our website, the data you provide in the form are used exclusively to manage your registration.
Your personal data are processed to handle your registration after filling the form. Fields are mandatory. The legal basis is necessity for legitimate interest of ELLE Midwives and you. This interest is processing your registration in the medical system. Data retained for full care period. You can also register by calling 010-2004 710 or emailing verloskundige@ellemidwives.nl.

Contact Form
Your personal data are processed to handle questions, complaints or other communication after form submission. Fields mandatory. Legal basis: necessity for legitimate interest of ELLE Midwives and you to handle your request. Data retained for full response and handling.

Improving Our Services
We may use your data to improve services only if provided for that purpose or with consent, e.g., feedback via complaints/survey forms.

Photos on Our Website
Photos may process personal data if depicting persons. Persons have consented to publication. Legitimate interest: placing/maintaining website, freedom of expression. Photos shown as long as valuable.

Registering for Courses, Workshops and Additional Services
Data processed to handle registration after form or signup. Mandatory fields. Data sent via unsecured email to organizer. Legal basis: necessity for legitimate interest of ELLE Midwives, provider and you to register and account for presence. Retained for organization duration. Also register by calling 010-2004 710.

This statement does not apply to third-party sites linked here. We cannot guarantee their handling of data. Read their privacy statements before use.

Retention Period
Medical files kept 15 years per Medical Treatment Agreement Act. Birth announcements/cards displayed indefinitely in waiting room then destroyed.

Processors and Other Third Parties
We may share data with third parties if necessary for above purposes. No sharing without processor agreement ensuring security. Not shared otherwise unless legally required/permitted. Access/provision to:
Researchers per Civil Code art. 7:458;
Insurers as needed for insurance obligations;
Debt collectors if necessary, non-medical;
Others if basis: consent, legal duty, vital interest protection.

Within the EU
No data to parties outside EEA without adequacy decision or binding instrument.

Your Privacy Rights
Right to access, rectification, deletion of received data. Object to processing by us/processors. Right to data portability to you/other. We may request ID verification.
If based on consent, withdraw anytime. May not fully delete due to legal retention; we'll inform. Contact via above. Also complain to Autoriteit Persoonsgegevens.

Complaints
For data processing complaints, contact us first. If unresolved, complain to Autoriteit Persoonsgegevens (privacy supervisor).
